The latest filing, obtained by multiple outlets, claims Christine (née Baumgartner) – with whom the 68-year-old Yellowstone the actor shares three children – refuses to leave their home, despite the terms of their 2004 prenup.

Kevin’s legal team, led by Laura Wasser, said in paperwork that the couple’s prenup stipulated his second wife had 30 days to leave home once she filed for divorce. She filed a case in Santa Barbara County Court on May 1, but still hasn’t moved. The Oscar-winning filmmaker’s team want the court to enforce the terms of the prenup, saying Christine “has taken the position that she will not leave Kevin’s separate residence” until he “accepts various demands financial”.

Kevin said in his statement, published by Radar Online, that he paid Christine $1 million after she filed for divorce, as per the prenup. However, she ignored “multiple requests” to leave their resort in Carpinteria, Calif. He said he would also give her $200,000 for a down payment on a new home and cover the cost of her mortgage, property tax and insurance for a year, per the prenup. In addition, he will contribute $30,000, as part of his child support obligation, to help her secure a rental and advance her $10,000 for moving expenses.

In his statement, he also said he gave Christine $100,000 on their wedding and $100,000 on their first wedding anniversary, which saved $450,000, which could also be used for the buying a new house.

He also claimed that since April, Christine had withdrawn from her bank account or charged her credit card $95,000 for attorney and accountant fees “without notice.”

The filing noted that Kevin had included specific housing plans in his prenuptial agreement with Christine because after his divorce from first wife Cindy Silva in 1994, he “found himself homeless and unable to live in his own home. .. He never wanted that to happen again.”

The documents also indicate that the field of dreams And dance with wolves The actor and Christine have agreed, in theory, to share custody. It is noted that he has a proposal for this, pays 100% of the expenses for the children and negotiates a schedule of summer visits for their teenagers: Cayden Wyatt, 15, Hayes Logan, 14 and Grace Avery, 13 .

“Kevin acted in good faith and did everything in his power to make the transition as seamless as possible,” Wasser wrote. “But Christine continues to refuse to leave her separate property residence, as she agreed she would in 2004 as a condition of marriage.”

Christine filed for divorce in May after 18 years of marriage, citing “irreconcilable differences”. She listed their separation date as April 11. His rep confirmed the news, saying, “It is with great sadness that circumstances beyond his control have occurred which have required Mr. Costner to participate in a marriage dissolution action.”

The rep later denied that Kevin had been unfaithful on the set of Yellowstone.

Earlier this month, Costner told Deadline he had taken out a mortgage on the property to partially fund his upcoming four-part film series titled Horizon: an American saga. “I did it without thinking,” he said. “It gave my accountant a frightening dizziness. Four years later, he discussed co-parenting after divorce in an interview with Red book. “My window of opportunity to be with them has been cut in half. It’s a logistical reality of separation. But what you do is make sure you take that time when it comes. You don’t want to be weekend dad or once a month dad And you don’t want to be a Disneyland dad Cindy and I have worked really hard to be there for them and love them Kids need to be comfortable with you. Cindy and I are both available to them. We’ve been truly blessed to be able to give them opportunities around the world, but there’s something to be said for just taking a Sunday and not even going to the park. We can just be home and enjoy each other. When my two weeks with them come around, it’s not how much I can make two fantastic weeks out of it.”

In 2012, he told the The Hollywood Reporter, “My faith has been shaken” after the divorce. “Nobody wants their marriage to end, and they do. You’re going to see the people you love the most, your kids, only half as much. It’s a huge loss.”
