Their prenuptial agreement included rules regarding legal challenges to the agreement
Kevin Costner now wants his ex-wife, Christine, to pay for her legal costs incurred in challenging their prenuptial agreement.
According to court documents filed Monday and obtained by PEOPLE, the actor/director, 68, is asking Christine, 49, to pay her $99,225 in legal fees. (A court date on this is set for August 2.)
Part of their prenup stated that if either party retained an attorney to “enforce or prevent a breach” of the agreement, “the prevailing party … shall have the right … to be reimbursed by the non-prevailing party for all costs and expenses incurred thereby.”
Costner’s filing also “respectfully reminded” the court that he set aside $1.5 million in a bank account for Christine as part of the prenup — funds she said she wouldn’t. did not want to touch in order to jeopardize his legal status in the divorce.

In an earlier filing, Christine, a now unemployed former handbag designer, and her legal team wrote, “Due to the vast difference in resources available to the parties, Christine is also asking Kevin to advance $350 An additional $000 in attorney fees and $150,000 in medical-legal fees.”
Her July 5 filing also called Costner’s quest to pay her legal fees.
“Kevin says he shouldn’t have to pay fees and expenses to Christine to challenge the validity of the PMA [pre-marital agreement]. He also regularly asserts that the PMA is valid and that there is no evidence to the contrary. It’s the legal equivalent of whistling in front of the cemetery.”
They added: “However, Kevin’s emphasis on PMA at this stage is premature and unrelated to Christine’s RFO for spousal support and costs. … As the Court can see from pleadings at this early stage, the fees and costs will be substantial because Kevin’s finances are complex, and also because Kevin is doing everything he can to minimize his obligations to his children.”
Christine had previously requested $248,000 a month in child support for their three children: Cayden, 16, Hayes, 14, and Grace, 13. She claimed that this amount was still “lower than the amount needed to keep the children in their usual lifestyle.” and also asked Costner to pay for his private school tuition, extracurricular and athletic activities, and health care costs.

Costner responded by calling Christine’s claim “grossly exaggerated and unsubstantiated”: “Providing minor children with more than bare necessities does not require providing ridiculous extravagance designed to primarily benefit the cared-for parent.”
The couple tied the knot in 2004 with a prenup in place a decade after Costner reportedly paid his ex-wife Cindy Silva $80 million in her first divorce. Christine filed for divorce on May 1, listing their separation date as April 11.
